RIDING LESSON PROGRAM AGREEMENT
This agreement, is entered into on the _________day of _________________, 20____, by and between _________________________________, (parent or legal guardian) who resides at __________________________________, ______________, CA for the equestrian training and lesson program for _______________________________ (riding lesson participant), hereinafter referred to as “student,” and Moon Chasers Riding Center, hereinafter referred to as the “school.”
Our Mission:
This is a family-friendly riding school that seeks to educate and empower enthusiastic young riders. Safety and continuous learning by our students are our primary concerns. We are committed to teaching our students all there is to learn about horsemanship and we see our students rise beautifully to our high expectations. That said, this is not a casual hobbyist school wherein students do not have a regular schedule and can drop in at will. We are happy to work with families if a vacation is planned, or illness occurs, and with good communication for things that can be planned, we are confident both student and school needs can be met.
PAYMENT AND CANCELLATION POLICIES:
Reservations for classes are on a month-to-month basis. Students learn best with a regular weekly schedule. A minimum of one lesson per week is required to hold a lesson slot, but at least two lessons per week is recommended for riding progression. Payment is due by the first lesson of each month. A late fee of $25 will be incurred if payment is not received by the end of the first week. You are responsible for paying all of your lesson fees each month, whether or not you attend your lesson.
LESSON PROGRAMS
Lessons include flatwork, obstacle maneuvering, trail work and jumping depending on ability and interest. Lessons begin at your lesson start time and end at your lesson end time. If the student has his/her own horse/pony and/or is capable of grooming, tacking and warming up their horse, they should arrive early and do so. This way, the majority of the lesson time is spent riding. Less experienced or younger students will be trained in grooming and tacking up as part of the lesson.
Lesson fees are as follows and are due at the beginning of each month for the upcoming month.The only exception to this are individually scheduled private lessons.
STUDENTS ON LESSON HORSES
Private lessons scheduled individually: $90/per lesson
Private lessons once per week: $350/month
Private lessons twice per week: $670/month
Once per week group lessons: $300/month
Once per week group with extra help: $350/month
Twice per week group lessons: $500/month
Twice per week group with extra help: $575/month
Half hour private pee-wee lesson: $275/month (one per week, no
grooming/saddling)
STUDENTS ON PRIVATE HORSES
Private lessons scheduled individually: $75/per lesson
Group lessons once per week: $300/month
Group lessons twice per week: $450/month
APPLICABLE TO ALL STUDENTS
Show Coaching Fees - Group Showing: $50/day
Show Coaching Fees: One Person Only: $150/day
Trailering Fee: $3/mile, split among participants
Unmounted Pony Club lessons: $5/student or $15/family
Clinics/Special Trainings: Varies
TRAINING SERVICES
Training Ride: $50/ride
Groundwork/lunging/trailer training: $35/hr, $25 minimum
CANCELLATION POLICY
These policies are driven by an expectation and hope of mutual courtesy and respect for each other’s time. You must pay your full lesson fees each month, whether or not you attend all, any or none of your lessons. We allow for one (1) make-up day per month. With prior approval, the student may attend another group lesson or arrange for a Saturday morning lesson, if scheduling allows. A minimum of 30-minute lead time for cancellation before class is expected. A no-show without calling to cancel forfeits the make-up day. If the makeup day is not taken within a month, it will be forfeited. An unmounted lesson may be held if any conditions make it unsuitable to ride, or the student may choose to attend a make-up day rather than attend lessons in bad weather. PAYMENTS ARE NON-REFUNDABLE
Tardies:
Students are expected to be on time or early to the lesson. If the student is late, it negatively impacts the others in the lesson. The lesson may begin without a student who is late and the student will be expected to catch up on their own. If a student is 15 minutes or more late to the lesson, the lesson will be forfeited for that day.
Photo Release:
By participating in this program, you are agreeing to have yourself and/or your child(ren) and family members photographed. These photos may be hung in the barn lounge, the meeting room, and may be used for marketing and promotion, including posts to social media, advertisements and fliers. By signing this agreement and participating in the program, you are agreeing to these terms and waiving any photographic rights.
Parent Participation:
Our program is successful in a large part to the wonderful families who are involved. Dedication of the families supporting the students is paramount to the success of the student and the program. Being a coach to so many kids and caring for so many horses is a huge, exhausting, and an expensive responsibility. When we have special events, shows and activities, please be prepared to help in any way you are able. In taking kids to shows and events, I spend a lot of my own time, money and resources, including fuel, feed, supplies, and wear and tear on the truck and trailer. I expect families to step up at these events and help where possible, which may include volunteering your time, purchasing supplies and/or providing meals. I will send out emails with requests for help as events approach.
Release of Liability:
1. HAZARDOUS ACTIVITY. I AM AWARE AND UNDERSTAND THAT THE HANDLING, CARE, AND RIDING OF HORSES ARE INHERENTLY DANGEROUS AND HAZARDOUS ACTIVITIES, AND I AM VOLUNTARILY PARTICIPATING AND/OR ALLOWING MY CHILD TO PARTICIPATE IN SUCH ACTIVITIES AND ASSUMING THE RISK OF BEING IN THE VICINITY OF SUCH ACTIVITIES, WITH FULL KNOWLEDGE OF THE DANGERS INVOLVED. I AM AWARE AND UNDERSTAND THAT HORSES ARE POWERFUL, UNPREDICTABLE AND POTENTIALLY UNCONTROLLABLE ANIMALS. ALL HORSES, EVEN THOSE THAT ARE WELL TRAINED AND APPEAR CALM AND DOCILE, MAY AND WILL BUCK, REAR, KICK, BITE, RUN, AND BOLT UNCONTROLLABLY, WITHOUT WARNING, AND WITHOUT APPARENT CAUSE OR IN RESPONSE TO EXTERNAL STIMULI THAT MAY INDUCE FEAR, PANIC, ANGER OR REFLEX ACTIONS IN THE HORSE. I AM AWARE AND UNDERSTAND THAT SERIOUS, PERMANENT BODILY INJURY AND DISABILITY OR DEATH OF MYSELF OR OTHERS WITHIN THE VICINITY OF HORSES MAY RESULT FROM THE HANDLING, CARE OR RIDING OF HORSES, OR BEING IN THE VICINITY OF HORSES, AND THAT HORSES AND OTHER PROPERTY BELONGING TO ME OR OTHERS MAY BE, AS APPLICABLE, KILLED, INJURED, OR DAMAGED. 2. I hereby agree to accept and assume any and all risks of injury (including permanent bodily injury and disability), illness, disease or death to myself, and all financial losses, injury damages, destruction and loss of my property and other persons’ property, arising from the handling, care or riding of horses at the Ranch by me or other persons, whether caused by the negligence of any of the Released Parties or otherwise. I further understand that it is my responsibility to be instructed in the proper methods of handling and riding a horse, and that I should wear proper safety equipment at all times while riding horses, including, without limitation, a helmet and riding boots, and that it is my sole responsibility to obtain safety equipment and safety instruction for this sport. 3. AGREEMENT NOT TO SUE. I HEREBY AGREE THAT I, MY INVITEES, MY HEIRS, DISTRIBUTEES, GUARDIANS, LEGAL REPRESENTATIVES, AND ASSIGNS WILL NOT MAKE A CLAIM AGAINST, SUE, DEMAND COMPENSATION OR INDEMNITY FROM, OR ATTACH ANY OF THE PROPERTY OR ASSETS OF THE RELEASED PARTIES, and each of them, from any loss or damage arising or resulting from any bodily injury, disability, illness, disease, death, financial loss, property loss, damage or destruction, or other harm or whatever nature, whether participation of any other person, in the handling, care or riding of horses, or the use of facilities or trails at the Ranch, whether caused by the negligence of any of the Released Parties or otherwise. 4. RELEASE. On behalf of myself, my heirs, children, distributees, invitees, guardians, legal representatives and assigns, I HEREBY RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES, AND EACH OF THEM, FROM ANY AND ALL CLAIMS, ACTIONS, DEMANDS, RIGHTS, CAUSES OF ACTION AND LIABILITIES, EITHER IN LAW OR IN EQUITY, based on any bodily injury, disability, illness, disease, death, financial loss, property loss, damage or destruction, or other harm of whatever nature, whether foreseen or unforeseen, that may be sustained or suffered by me, my horse, or by any other person as a direct consequence of my participation in the handling, care or riding of horses, or the use of the facilities or trails of the Ranch, or the transportation of my horse, or any other horse, for veterinary care, or the administration of any aid or veterinary care to any such horses, or failure to arrange for any such transportation, aid, or care, whether caused by the negligence of any of the Released Parties or otherwise. 5. INDEMNIFICATION. I HEREBY AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS EACH OF THE RELEASED PARTIES from and against any and all claims, suits, demands, liabilities, damages, losses, costs and expenses (including, but not limited to, attorney’s fees and all costs) arising from, or in connection with the injury, illness, or death of myself, my horse or any person whom I bring or invite to the Ranch, or otherwise permit to be in the vicinity of any horse in my possession or under my control, or the damage, destruction or loss of any of my or their property. 6. REPRESENTATIONS. I REPRESENT AND STATE THAT (a) I have read this release carefully and I fully understand all of it’s terms and provisions; (b) I am 18 years of age or older and am legally competent to enter into this Release; (c) no promise, inducement or agreement has been offered or made to me in connection with my execution and delivery of this Release and (d) I have knowingly and voluntarily executed and delivered this release understanding the risk and have done so of my own free will, without relying on any statement or representation of any Released Parties. I understand and acknowledge that this release is a release of legal liability, in the event of any litigation, this release may be raised as a defense and bar to, and as a waiver and release of, legal rights that might otherwise be asserted by me or by my respective heirs, distributes, invitees, guardians, legal representatives and assigns. I understand that I may have this document reviewed and explained to me by an attorney of my own choosing. 7. SEVERABILITY. If one or more provisions of this Release are held to be unenforceable under applicable law, each unenforceable provision shall be excluded from this release and the balance of this Release shall be interpreted as if each such unenforceable provision were excluded, and the balance of this Release as so interpreted shall be enforceable in accordance with its terms.
